PLEASE READ BEFORE USING MAPDAZE.COM

Mapdaze.com (sometimes referred to as MAPDAZE) is a service that allows registered users to embed maps into their blog or other sites. Mapdaze.com also allows such users to add markers into maps. These markers may be used by Mapdaze.com to link to the users website.

These terms of service ("TOS") contain the terms and conditions that govern your use of the Web Site and Mapdaze.com services as described above. These TOS describe your rights and responsibilities and what you can expect from the Mapdaze.com Service.

DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF MAPDAZE IS AT YOUR SOLE RISK. MAPDAZE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. MAPDAZE MAKES NO WARRANTY THAT (1) ITS SERVICE WILL MEET ANY REQUIREMENT THAT YOU HAVE, (2) ITS SERVICE WILL BE ERROR FREE, UNINTERRUPTED, TIMELY OR SECURE (3) ANY INFORMATION OBTAINED FROM MAPDAZE WILL BE ACCURATE OR RELIABLE (4) THE QUALITY OF ANY PRODUCTS OBTAINED BY YOU THROUGH MAPDAZE WILL MEET YOUR EXPECTATIONS, (4) IT WILL OPERATE IN THE CONFIGURATION OR WITH THE HARDWARE OR SOFTWARE YOU USE, AND (5) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED

YOU EXPRESSLY UNDERSTAND AND AGREE THAT MAPDAZE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF MAPDAZE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE MAPDAZE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM MAPDAZE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON MAPDAZE; OR (v) ANY OTHER MATTER RELATING TO MAPDAZE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU BUT ONLY TO THE EXTENT REQUIRED BY APPLICABLE LAW.

APPROPRIATE USAGE

Pursuant to Google Maps Terms of Service, maps must be made freely accessible to users. You must also agree to the Google Maps API Terms of Service prior to using mapdaze

Maps created must not mark places of illegal activity, places to obtain objects that are illegal to have or use. Furthermore, to respect individual privacy, the maps created should not be used to identify personal information about private individuals.

You may not remove, distort or alter the text to Mapdaze or any of our third party copyright signs and logos (this includes squeezing, stretching, inverting, discoloring, etc.).

You may not interfere with or disrupt Mapdaze services or servers or networks connected to Mapdaze services

Mapdaze owns all copyright to the Mapdaze site, images, software, and other parts of this website. Sections of our website are based on or granted by third party products. Those third parties exclusively owns such materials. Mapdaze grants you permission to use the application to create and show maps on your own site. You may not resell or redistribute any images, code, or text from our services without our prior consent.

ELIGIBILITY

Mapdaze.com will only knowingly provide services to parties that can lawfully enter into and form contracts under applicable law. If you are under the age of 18, but at least 13 years of age, you may use the Mapdaze.com Service only under the supervision of a parent or legal guardian who agrees to be bound by these TOS. Mapdaze.com is not intended for children under the age of 13.

Mapdaze.com grants you a limited revocable license to access and use these services for its intended purposes, subject to your compliance with these TOS. This license does not include the right to collect or use information contained on the Web Site for purposes prohibited by Mapdaze.com; to compete with Mapdaze.com; or download or copy the Web Site (other than page caching). If you use the Web Site in a manner that exceeds the scope of this license or breach this TOS, Mapdaze.com may revoke the license granted to you.

Mapdaze.com may use a third party to create certain services accessible through the website. We may not be in anyway affiliated with these third-party services, and as such, you understand that these third parties do not endorse our services in anyway. Mapdaze.com does not control those third parties or their services, and you agree that Mapdaze.com will not be liable to you in any way for your use of such services.

These third parties may have their own terms of use and other policies. You must comply with such terms and policies as well as these TOS when you use these services. If any such terms or policies conflict with Mapdaze.com's TOS, agreements or policies, you must comply with Mapdaze.com's TOS, agreements or policies, as applicable.

Mapdaze.com will not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any content, goods, or services available through these sites.

USER GENERATED CONTENT

Mapdaze.com also hosts user generated content. Mapdaze.com is not responsible or liable for user's content and does not endorse them. Mapdaze.com will not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any user's content.

INDEMNIFICATION.

You agree to indemnify and hold Mapdaze, and its affiliates, officers or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content you submit, post, transmit or make available through Mapdaze, your use of Mapdaze, your connection to Mapdaze, your violation of the TOS, or your violation of any rights of another.
